The 59-year-old had only attached an insurance license plate to the Seat, although the car is to be classified as a classic passenger car and is therefore subject to registration, tax and insurance obligations. In addition, the officers found significant defects in the car. The brakes only worked with a delay, the handbrake was almost without function, there was a hole in the footwell, the entire underbody was eaten away by rust and the cross members of the bodywork were broken in several places. The 59-year-old also could not show the police a driver's license, as he does not have a driving license at all. Due to the existing defects, the road safety of the Seat was no longer guaranteed. The officers prohibited the driver from continuing his journey. The police initiated criminal and administrative offense proceedings against the 59-year-old.
